One benefit of arranging a Deed of Separation is that it can be used in the courts if you decide to divorce. By doing it during your separation, it will save both you and your partner any further headaches. For couples with children, the legal battle can become very nasty. By both parties agreeing upon things early, it will keep both you and your partner from arguing during the divorce trial. Unfortunately, when children are involved spouses are still required to maintain somewhat of a relationship.
Often enough, one person in the marriage does not always approve of a separation. In this case, the other partner will have to go before a judge and plea for a 'Judicial Separation'. The person before the judge has to give a reason why they ask for the separation. The only downfall to this procedure is that the judge is able to decide all of the details of the separation. The judge will be able to assign who gets any property, custody of the children, or any money that has to be paid. The judicial separation does not mean in any way that you are divorced as of that moment. It is simply a system available to those who are the only ones in the partnership wanting the separation. You must still be separated for one year before divorce can become final.
